These Terms govern access to LandVerify and are intended to operate together with the Privacy Policy for public-facing legal disclosure, authentication, property verification workflows, document uploads, cloud-based infrastructure usage, payment handling, report generation, and digital communication services used by the platform.

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the LandVerify mobile application, website, and related services (collectively, the “Services”) operated by J Aryavarta Tech Private Limited (“Company”, “we”, “us”, “our”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

2. Definitions

“User”, “you”, and “your” mean any person who accesses or uses the Services. “Verification Request” means a request submitted through the Services for review of land or property records, documents, history, ownership-related information, litigation status, encumbrances, or related matters. “Report” means any summary, finding, record compilation, opinion note, verification output, or final findings communication provided through the Services. “Property Data” means any address, map selection, coordinates, khasra number, survey number, village, tehsil, document, or other information submitted or collected for a Verification Request.

3. Eligibility

You may use the Services only if you are at least 18 years old and legally competent to enter into a binding contract under applicable law. If you use the Services on behalf of another individual, entity, family, developer, broker, or organisation, you represent and warrant that you are duly authorised to do so and to bind such person or entity to these Terms.

4. Nature of Services

LandVerify is a technology-enabled property verification platform. We facilitate collection, review, and verification of property-related information through internal processes and, where necessary, through advocates, legal professionals, clerks, field personnel, consultants, and other service providers. The Services are intended to help users better understand the historical and legal background of land and constructed properties, including possible ownership issues, encumbrances, legal liabilities, and court-related matters.

5. Informational Purpose Only

The Services and any Report are provided for informational, assistance, and due-diligence support purposes only. Unless expressly stated in a separate written engagement signed by an authorised representative of J Aryavarta Tech Private Limited, nothing on the Services constitutes legal advice, title certification, title insurance, financial advice, investment advice, or a guarantee that any property is free from dispute, defect, claim, or risk. You remain solely responsible for your property decisions, including whether to purchase, sell, finance, lease, or otherwise deal with any property.Users are encouraged to independently consult qualified advocates, legal counsel, financial advisors, surveyors, or technical experts where appropriate before making significant property-related decisions.

6. No Guarantee of Accuracy or Outcome

The Services may rely on user-submitted documents, uploaded files, government records, registry extracts, court information, local office searches, authentication data, payment references, map-related selections, and other third-party or public sources. Such sources may be incomplete, delayed, inaccurate, inaccessible, inconsistent across departments, or subject to later change. Accordingly, we do not warrant or guarantee the accuracy, completeness, reliability, availability, or fitness of any information, Report, or verification outcome. A Report reflects information available at the relevant time and jurisdiction and may not reveal every defect, claim, oral arrangement, fraud, forgery, undisclosed heirship issue, pending proceeding, or off-record liability.Government portals, registry systems, revenue records, court databases, and public data systems may become unavailable, delayed, inaccessible, or modified without notice.

7. Verification Process and Timelines

Verification timelines vary depending on the location of the property, availability and quality of records, cooperation of third parties, government office processes, court access, local holidays, connectivity issues, document complexity, communication delays, and technical dependencies. Any timeline provided by us is only an estimate unless expressly agreed in writing. We are not liable for delay caused by government departments, registry offices, courts, payment gateways, authentication providers, email providers, network issues, force majeure events, or other factors beyond our reasonable control.

8. User Responsibilities

You agree to provide accurate, complete, current, and lawful information in connection with any Verification Request. You represent and warrant that you have all necessary rights, authority, permissions, and lawful basis to submit Property Data and documents to us, including documents relating to co-owners, sellers, family members, tenants, attorneys, or other third parties. You must not upload forged, misleading, illegal, defamatory, infringing, or unauthorised material. You are solely responsible for the authenticity, legality, and sufficiency of all material you submit.

9. Account, Authentication, and Acceptance Records

You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. You acknowledge that we may use third-party authentication providers, including Google Sign-In, subject to the applicable provider’s terms and permissions. We may process account identifiers, session data, and refresh or access tokens, or their secured equivalents, as reasonably necessary to maintain account access and security. We may maintain digital records of your acceptance of these Terms, including timestamp, user ID, device or session information, and related logs, and such records shall be admissible to the extent permitted under applicable law as evidence of acceptance and use. You acknowledge that authentication, session management, and account-access functionality may rely on cloud-hosted infrastructure, third-party identity providers, secure token systems, and related technical integrations reasonably necessary for operation and security of the Services.

10. Maps and Location Functionality

The Services may use map and location functionality to help identify the relevant property. Where you grant location permission while using the app, the app may access device location to assist map loading, search, and property selection. You may also manually search or enter property-related address details where available. Use of location functionality does not guarantee precision of verification results and remains subject to the limitations of maps, records, and user-provided information.

11. Payments, Pricing, and Taxes

Fees for the Services are displayed in the app or otherwise communicated before you confirm a Verification Request. Payments are processed through third-party payment processors, banking networks,and gateway providers, including Razorpay or similar services. You agree to pay all applicable charges, convenience fees, gateway charges, and taxes, including GST where applicable. We may change pricing prospectively at any time, but any such change will not affect a Verification Request already paid for and accepted by us unless additional scope is requested by you.We do not directly collect or store complete debit card numbers, credit card numbers, banking passwords, UPI PINs, or equivalent sensitive payment credentials on our own servers.

12. Refunds and Cancellations

Unless otherwise required by applicable law, fees paid for a Verification Request are non-refundable once work has begun, including where records searches, lawyer review, field verification, or document analysis has commenced. A refund, whether full or partial, may be considered at our sole discretion where: (a) we are unable to process the request for operational reasons; (b) duplicate payment is made; or (c) cancellation is requested before meaningful work has started. If the scope materially changes after review of your submission, we may inform you of additional charges or limitations before proceeding further.

13. Delivery of Reports

Reports, copies, summaries, and related materials may be delivered through the app, email, download link, or other digital means determined by us. Verification findings and final reports may be sent using email communication and delivery services such as Resend, Gmail, Zoho Mail, or similar providers.. You are responsible for reviewing the delivered material promptly and notifying us within a reasonable time if you believe the wrong property, wrong jurisdiction, or incomplete user-submitted inputs were used. Delivery shall be deemed completed when the Report is made available through the account, app, email, or contact details provided by you. Users acknowledge that email delivery, spam filtering, network delays, third-party email provider restrictions, or recipient-side configuration issues may affect electronic delivery timelines.

14. Confidentiality

We will treat documents and information submitted by you as confidential and will use or share them only as reasonably necessary to provide the Services, comply with law, protect rights, process payments, authenticate users, send reports, or enforce these Terms. You acknowledge that performance of the Services may require sharing relevant material with advocates, legal professionals, clerical staff, technology providers, authentication providers, email providers, and government offices on a need-to-know basis. Your use of the Services is also subject to our Privacy Policy.

15. Admin Review and External Professional Assistance

Uploaded documents and verification materials may be reviewed by authorised internal administrators through a role-based admin portal for processing, review, and preparation of findings. External advocates or third-party professionals engaged for verification do not necessarily receive direct portal access, but may be provided relevant information, extracts, or supporting materials through controlled communication channels where necessary to perform verification work.

16. Third-Party Services and Sources

The Services may incorporate or depend on third-party infrastructure, cloud services, platforms, and data sources, including Google Sign-In or similar authentication providers, Google Maps and related mapping/location services, payment processors such as Razorpay, backend infrastructure and application hosting providers such as Railway, cloud storage, networking, domain, and security-related services associated with Cloudflare and landverify.land, deployment and web infrastructure providers such as Vercel, email delivery and communication providers such as Resend, Gmail, Zoho Mail, government portals, registry systems, public databases, and professional advisors.

17. Cloud Infrastructure and Digital Services

The Services operate using cloud-hosted infrastructure, networking systems, storage providers, authentication services, communication platforms, and related digital technologies necessary for operation, security, scalability, report delivery, and account management.

You acknowledge that temporary outages, delays, maintenance periods, connectivity interruptions, provider-side incidents, or third-party platform limitations may affect portions of the Services from time to time.

18. Acceptable Use Restrictions

You agree not to use the Services for any unlawful, fraudulent, or deceptive purpose, upload forged or manipulated documents, attempt unauthorised access, copy or disrupt the Services, misuse any Report to harass or unlawfully pressure any person, or otherwise violate privacy, confidentiality, intellectual property, or other rights of any person.

19. Intellectual Property

The Services, including all software, design, layout, databases, workflows, text, branding, logos, features, and underlying technology, are owned by or licensed to J Aryavarta Tech Private Limited and are protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for your personal or internal lawful use.

20. Limited License to User Content

By submitting documents, notes, coordinates, property details, and other materials through the Services, you grant us a limited, non-exclusive, royalty-free license to host, store, reproduce, transmit, review, analyse, and share such material strictly to the extent necessary to provide the Services, improve internal operations, comply with legal obligations, prevent fraud, and enforce our rights. You represent that granting this license does not violate any law or third-party rights.

21. Suspension and Termination

We may suspend, restrict, or terminate your access to the Services, cancel a Verification Request, or refuse future use at our discretion if we believe that you have violated these Terms, the information provided by you is false or suspicious, your conduct exposes us or others to legal, regulatory, or security risk, or continued provision of the Services is impracticable or unlawful.Users may also request account deletion or discontinuation of Services, subject to applicable legal obligations, fraud prevention requirements, ongoing disputes, payment issues, operational retention needs, or lawful recordkeeping obligations.

22. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided on an “as is”, “as available”, and “with all faults” basis. We disclaim all express and implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and quiet enjoyment. We do not warrant that the Services will be uninterrupted, secure, error-free, or suitable for your specific transaction or legal objective.

23. Limitation of Liability

To the maximum extent permitted by law, J Aryavarta Tech Private Limited, its directors, employees, affiliates, consultants, advocates, agents, and service providers shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, or for any loss of profit, revenue, business, opportunity, goodwill, data, or expected savings arising out of or related to the Services or any Report. Subject to the foregoing, our aggregate liability for any claim arising out of or related to a specific Verification Request shall not exceed the amount actually paid by you for that Verification Request.

24. Indemnity

You agree to defend, indemnify, and hold harmless J Aryavarta Tech Private Limited, its directors, employees, affiliates, consultants, advocates, agents, and service providers from and against any claims, actions, proceedings, liabilities, losses, damages, penalties, costs, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, false or unlawful submissions, infringement of third-party rights, or misuse of the Services or any Report.

25. Force Majeure

We shall not be liable for any delay, interruption, or failure to perform resulting from causes beyond our reasonable control, including natural disasters, fire, flood, epidemic, pandemic, civil disturbance, labour disputes, government action, court closure, internet or telecom failure, cyber incidents, power failure, third-party platform failure, disruption of public records systems, or email delivery failure beyond our control.

26. Privacy

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, store, process, and share your personal data and property-related information. By using the Services, you acknowledge that you have read and understood the Privacy Policy.

27. Changes to the Terms

We may update these Terms from time to time. When we do so, we will revise the “Last Updated” date and may provide additional notice through the app, website, email, or other reasonable means where the changes are material. Your continued use of the Services after such updated Terms become effective constitutes your acceptance of the revised Terms.

28. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable dispute resolution provisions, the courts at Jodhpur, Rajasthan shall have exclusive jurisdiction over all matters arising out of or relating to these Terms and the Services.

29. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Services, the parties shall first attempt to resolve the matter amicably through good-faith discussions. If the dispute is not resolved within 30 days, it may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Jodhpur, Rajasthan, India, the proceedings shall be conducted in English, and the award shall be final and binding, subject to applicable law.

30. Severability and Waiver

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect. Any failure by us to enforce any provision shall not constitute a waiver of our right to enforce that or any other provision at a later time.

31. Entire Agreement

These Terms, together with the Privacy Policy and any additional written scope, pricing, or engagement terms expressly accepted by us, constitute the entire agreement between you and J Aryavarta Tech Private Limited regarding the Services and supersede prior discussions or understandings to the extent relating to the same subject matter.
